Terms of Use

Website Terms of Use and Sale

All of our items come with a money-back guarantee if you are not satisfied. Please contact us with any problems.

1 About these Terms

These Website Terms of Use and Sale govern your use of oxxbridgegalleries.com and oxxbridge.com and your purchases through that store. Oxxbridge Galleries LLC (Oxxbridge, we, us, or our) is the seller. You means the person using the website or placing an order. These Terms do not govern purchases through our separate eBay business.

Our store sells physical books, magazines, photographs, and other collectibles from inventory we own. Purchases are one-time transactions. We do not sell digital products, preorders, subscriptions, or gift cards through this store.

Our Shipping, Returns, and Refunds Policy forms part of these Terms and provides the details of shipping, cancellations, returns, and refunds. Our Privacy Policy explains how the store handles personal information.

Shopify hosts our store and processes visitor and customer information. If Shopify Network Intelligence and related Enhanced Services are enabled, Shopify acts as an independent controller and uses interactions with this store, other merchants, and Shopify for analytics, personalization, and improved or targeted advertising. Shopify and other providers may process information abroad. Our Privacy Policy explains their roles and your choices.

By selecting a control that expressly states you agree to these Terms, you accept them. You must review them before agreeing or placing an order. If you do not agree, do not use the store or place an order. Section 15 contains binding individual arbitration and a class-action waiver for U.S. customers who accept these Terms, with a small-claims exception and a right to opt out.

These Terms apply prospectively after publication. The version you accept when placing an order governs that order. Changes do not alter earlier purchases or rights that have already arisen. Nothing in these Terms limits a consumer right or remedy that applicable law does not allow us to exclude or restrict.

2 Age and access requirements

The website contains nudity and explicit depictions of sexual activity. You must be at least 18, legally able to enter into a purchase contract, and legally permitted to view the website and buy and receive the material where you are located. Do not enter if you do not wish to view adult material. You must not buy adult material for a minor or knowingly give a minor access to it.

Any age affirmation you provide is your statement of eligibility; it is not confirmation that we have checked your identification. You must provide truthful information.

We restrict website access from certain locations and may change those restrictions. You must not circumvent an access restriction. Website access restrictions are separate from shipping eligibility. A restriction on access from a state does not, by itself, mean that we refuse shipments to addresses in that state. Shipping remains subject to section 6 and applicable law.

3 Product descriptions and availability

Many items are vintage, previously owned, or available in a single copy. Read the full description and examine the photographs before ordering. Age, wear, markings, fading, and similar characteristics can affect condition and value. We describe known condition issues that are not apparent in the listing photographs. An item sold as used or vintage is not represented as new.

Descriptions of condition, edition, date, publisher, photographer, and provenance identify what we are offering. Dates or attributions described as approximate or uncertain must be understood on that basis. Screen settings can affect displayed colors, and listing images do not show every interior page. These explanations do not excuse an inaccurate description or an undisclosed defect for which we are legally responsible. Contact us before ordering if a detail matters to your purchase.

Adding an item to your cart does not reserve it. Availability can change before we accept your order. If an item is unavailable, we will notify you and refund the amount paid for it. We will not substitute a different item without your agreement.

We do not provide a separate lifetime or 12-month guarantee, including a lifetime authenticity guarantee, for purchases governed by these Terms. Product descriptions and your legal rights remain applicable. Our voluntary return policy is in section 8.

Historical publications reflect their original creators’ views and can contain offensive language or depictions. Selling or displaying an item does not mean that we endorse those views or conduct.

4 Orders and cancellation before shipment

Your order is an offer to buy the selected items. An automated order receipt, payment authorization, or payment collection does not by itself mean that we have accepted the order. We accept an order when we hand the items to the carrier for shipment. You must provide an accurate name, email address, delivery address, and any telephone number required at checkout. If you order for someone else, you must have authority to provide their information and arrange delivery.

We may decline or cancel an unshipped order because of unavailable inventory, a pricing or listing error, failed payment, suspected fraud, an ineligible customer or destination, or another reasonable fulfillment or legal concern. If we find an error affecting your order, we will ask whether you want to proceed on corrected terms or cancel and refund it. We will not charge more or change the item without your agreement.

You may cancel before shipment by emailing oxxbridge@gmail.com or calling 888-695-5355 with your order details. We will cancel if we receive your request before handing the items to the carrier. Because we generally process orders quickly, contact us as soon as possible. After shipment, sections 8 and 9 apply.

If an entire order is canceled before shipment, we will refund all payments for that order, including shipping and taxes we collected. For a partial cancellation, we will refund the canceled items, related taxes, and shipping charges attributable to those items. We will issue these refunds to the original payment method no later than 7 business days after cancellation, or sooner if law requires. Payment-provider posting times can vary. Our acceptance procedure does not postpone any legal shipment, cancellation, or refund deadline.

5 Pricing payment and taxes

The price, currency, available payment methods, shipping charges, and taxes we collect are displayed at checkout. You must review the total before submitting your order. Prices and offers can change for future orders. Any discount or free-shipping offer applies only on its stated terms; a U.S. shipping offer does not cover international shipping unless expressly stated.

Payment is due before shipment. You must use an authorized payment method and authorize collection of the checkout total. Payment options can depend on your location and the transaction; a payment logo elsewhere on the site does not guarantee that method is available for your order.

Checkout calculates taxes we collect based on the transaction information. Taxes or import charges payable directly to a government, carrier, or customs authority are addressed in section 7. Your bank or payment provider can charge currency-conversion or other fees under its own terms. We do not control those fees.

If you believe a charge is incorrect, contact us so we can investigate. Nothing in these Terms restricts a lawful billing dispute, chargeback, or payment-provider remedy. You must not submit a knowingly false payment dispute or seek duplicate reimbursement for the same loss.

6 Shipping and delivery

We generally process paid orders and arrange shipment with tracking within 24 hours, excluding Saturdays, Sundays, and postal holidays. Incomplete order information, payment issues, and unexpected fulfillment problems can cause delays. This is a processing estimate, not a promise of delivery within 24 hours. Available services and shipping charges appear at checkout. USPS package services include USPS Ground Advantage and Priority Mail when offered.

Delivery dates and transit times are estimates unless we expressly identify a guaranteed service for your order. Transit depends on the carrier, destination, and customs processing. If we cannot ship by the time stated for your order, we will notify you, provide a revised shipment date if available, and give you the choice to agree to the delay or cancel for a refund. We will obtain any consent required by law and cancel and refund the unshipped items if that consent is not obtained.

We do not ship to prisons. We may decline or cancel delivery to an institutional address, including a religious establishment, or another location if the material is prohibited by law or institutional rules, reasonably appears unwelcome, or cannot be shipped because of carrier restrictions. We apply these restrictions based on delivery conditions, not a customer’s religion or other legally protected characteristic. We will notify you and refund any canceled, unshipped order.

Check your address before ordering. If a package is delayed, missing, marked delivered but not received, or damaged, contact us with your order number and available details. Keep the item and packaging while we investigate if reasonably possible. We will work with the carrier and provide any refund, replacement, or other remedy required by these Terms or law. A tracking entry alone does not eliminate a valid claim of non-delivery.

Risk of loss passes to you when you or a person you designate takes physical possession of the goods. If a package is returned because you supplied an incorrect address, refused delivery, or failed to collect it, we will contact you about reshipment or a refund. You are responsible for reasonable additional shipping costs caused by those circumstances, but we will deduct costs from a refund only as applicable law permits. This does not apply to a valid cancellation or a delivery problem for which we are responsible.

7 International orders

We ship worldwide, subject to applicable law, carrier availability, and the destination restrictions in section 6. An item that can lawfully be sold in the United States is not necessarily lawful to import or possess elsewhere. Before ordering, you must check the rules applicable to the selected material in the destination country and provide accurate customs and delivery information. We may decline a shipment we cannot lawfully fulfill.

Unless checkout expressly includes them, you are responsible for import duties, import taxes, customs-clearance charges, and similar destination charges. We will not misstate the contents, value, or purpose of a shipment. Customs inspections and import restrictions can delay, return, or prevent delivery.

If customs detains, rejects, or returns an order, contact us so we can determine what happened and the remedy available. Any reshipment, refund, or deduction of actual nonrecoverable costs is subject to applicable consumer law. Government charges paid directly by you generally must be reclaimed from the collecting authority. These provisions do not transfer to you a legal obligation imposed on us as the seller or exporter.

8 Thirty day returns and refunds

All items offer a money-back guarantee if you are not satisfied. Please contact us with any problems.

Return period. You may request a return for any reason no later than 30 calendar days after the date of sale shown on your order receipt. This period runs from the sale date, not delivery. Email oxxbridge@gmail.com or call 888-695-5355 with your order details. We will provide return instructions and the return address. Send the item no later than 14 calendar days after we provide those instructions. A timely request remains eligible while you are waiting for our instructions.

Condition. Return the same item in the condition in which you received it, with all pages and components included. You may handle it reasonably to inspect it, but must not mark, alter, repair, or damage it. Pack it securely and retain evidence of shipment. Contact us before sending a return so it goes to the correct address. These requirements do not remove a statutory right to reject faulty or misdescribed goods.

Shipping costs. For an ordinary change-of-mind return, original shipping charges are not refunded and you pay return shipping. We may agree to reimburse either or both shipping charges for an individual return. We will pay or reimburse shipping whenever applicable law requires it. Refunds for unshipped orders follow section 4, and statutory cancellation refunds follow section 9.

Refund amount and timing. We will refund the purchase price and related taxes we collected for an eligible return. We do not charge a restocking fee or deduct the cost of free outbound shipping from an eligible return refund. If you caused additional damage or return an incomplete item, we may reduce the refund to reflect the resulting loss in value, as law permits. We will explain any deduction. We will issue the refund to the original payment method no later than 14 calendar days after receiving the return, or sooner if law requires. We will not require you to accept store credit.

Wrong, damaged, or misdescribed goods. Contact us as soon as you discover a problem. Provide reasonable information or photographs that will help us resolve it, if available. We will provide the remedy required by applicable law, which can include a refund, repair, or replacement and reimbursement of necessary shipping. A replacement is subject to availability because many items are unique. The 30-day voluntary return period does not shorten a statutory warranty, rejection period, or deadline for bringing a legal claim.

9 Statutory cancellation rights

If you are a consumer in the European Economic Area or United Kingdom and applicable law gives you a right to cancel a distance purchase, that right applies in addition to section 8. It generally allows you to cancel without giving a reason by sending a clear cancellation notice no later than 14 days after you or your designated recipient receives the goods. For one order delivered in separate shipments, the period runs from receipt of the last item. Any longer period required by law applies. Statutory exceptions can apply to particular products, including individual newspapers, periodicals, and magazines; those exceptions do not remove our voluntary return policy or rights for faulty goods.

Send your notice to the email or postal address in section 18. You may also use the “Withdraw contract” button displayed on our store pages. Sending a clear notice before the applicable deadline is sufficient; you do not need our approval. Return the goods without unnecessary delay and no later than 14 days after notifying us. You pay direct return costs unless we agree otherwise or law requires us to pay.

For a valid statutory cancellation, we will refund the payments for the canceled purchase, including the cost of our least expensive standard delivery option where required. We do not have to refund the additional cost of a more expensive delivery method you selected. We will refund without unnecessary delay and no later than 14 days after receiving your cancellation notice, but may withhold payment until we receive the goods or evidence you sent them back, whichever happens first, unless we have offered to collect the goods. We will use the original payment method unless you expressly agree otherwise, without charging a refund fee. We may deduct a loss in value caused by handling beyond what is necessary to establish the goods’ nature, characteristics, and functioning, only as law permits.

You may use the optional cancellation form below, but any clear statement of cancellation is sufficient. Other mandatory cancellation and consumer rights, including rights under laws outside the EEA and United Kingdom, remain available.

10 Accounts and acceptable website use

If you create an account, you must keep your login details secure, provide accurate information, and notify us of suspected unauthorized access. Do not use another person’s account without permission. You are responsible for activity you authorize, but are not automatically responsible for unauthorized activity caused by our failure to meet a legal duty.

You must not use the website to commit fraud, impersonate another person, harass anyone, transmit malicious software, interfere with the store, or violate another person’s rights. You must not attempt unauthorized access, bypass security or location controls, use automated tools to scrape or extract site content without permission, or place orders to manipulate or disrupt availability. These restrictions do not prevent activity protected by law.

The store does not offer customer reviews or public photo uploads. Information you send through customer service must be lawful and must not include another person’s confidential information without authority. Do not send full payment-card details or identification documents through an ordinary contact message.

We may restrict or suspend website or account access to address a violation, suspected fraud, a security problem, or a legal requirement. We may also change or discontinue website features. Doing so does not cancel our obligations for an accepted order or remove your refund or other legal rights.

11 Intellectual property

Oxxbridge and the relevant rights holders own the rights in the website’s design, text, logos, photographs, and other content. Rights in the underlying publications and depicted works remain with their respective owners. Our display of an item does not mean that we own all rights in it.

You may browse the website and save or print information reasonably needed for your own shopping and purchase records. Except as law permits or the rights holder authorizes, you must not reproduce, distribute, republish, sell, or use website content commercially, remove rights notices, or use our branding to suggest sponsorship or affiliation.

Buying a physical item transfers ownership of that copy, not copyright or other intellectual-property rights. Nothing in these Terms restricts a lawful resale of the physical item or another use permitted by law.

12 Website availability and outside services

We do not promise uninterrupted or error-free website access or that the website will meet a particular technical requirement. We may interrupt access for maintenance, security, or other reasonable reasons. You should use appropriate security protections for your device. These statements do not limit our responsibility for products, payments, or a failure to meet a legal duty.

Links and payment services can take you to websites or services operated by others. Their terms apply to their own services. A link does not imply endorsement, and we do not control their content or operation. Their involvement does not remove our responsibilities as the seller.

13 Product rights and limits on liability

Your product and consumer rights remain protected. We do not exclude implied warranties of merchantability or fitness for a particular purpose for goods where they apply. Items must match their descriptions and meet applicable legal standards, taking account of their disclosed age and condition. We do not promise a collectible’s future resale price or investment value.

Limited liability. Subject to the exceptions below, our total liability for all claims relating to the same order, taken together, is limited to the total you paid for that order. For a claim relating only to website use, the limit is US$100. We are not liable for business losses, including lost resale profits or business opportunities, subject to the same exceptions.

These limits do not apply to required refunds; liability for fraud, intentional misconduct, or gross negligence; death or personal injury caused by our negligence; or any liability, warranty remedy, statutory damages, legal fees, or other consumer remedy that applicable law does not allow us to exclude or limit. For EEA and UK consumers, these limits also do not restrict recovery of reasonably foreseeable loss caused by our breach. No provision requires you to waive a nonwaivable right under New Jersey law or another applicable consumer law.

14 Governing law

New Jersey law governs these Terms and purchases through the store, except that the Federal Arbitration Act governs section 15. This choice does not deprive a consumer of mandatory protections under the law of their place of residence that would otherwise apply. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

15 Individual arbitration for United States customers

Scope and court waiver. This section applies only if you reside in the United States when you accept these Terms. Subject to the exceptions below, you and Oxxbridge must resolve disputes arising from these Terms, website use, or purchases by binding individual arbitration administered by NAM (National Arbitration and Mediation). This includes contract, tort, and statutory consumer claims. Arbitration uses a neutral arbitrator instead of a judge or jury, ordinarily has more limited discovery, and permits only limited court review. You and Oxxbridge waive the right to have covered disputes decided in court by a judge or jury. This section does not apply to a dispute that arose before you first accepted it.

Small claims and protected remedies. Either party may bring an individual claim in a small-claims court with jurisdiction if the claim qualifies and remains there. Claims or remedies that law prohibits us from requiring to be arbitrated, including any nonarbitrable claim for public injunctive relief, remain available in court. You may contact a government agency or use a lawful payment dispute process.

Procedure and hearings. NAM’s Comprehensive Dispute Resolution Rules and Procedures, consumer fairness standards, and applicable consumer fee schedule govern. They are available at https://www.namadr.com/resources/rules-fees-forms/ or by calling 800-358-2550. Either party may file with NAM. One neutral arbitrator will hear the dispute. Hearings will be by videoconference or telephone unless both parties agree otherwise or the arbitrator determines an in-person hearing is needed for fairness. An in-person hearing must be reasonably accessible to you, ordinarily in your county of residence. A dispute may be decided on written submissions if both parties agree.

Fees and remedies. Your filing fee will not exceed the lower of NAM’s applicable consumer filing fee and the fee to file a comparable claim in your local court. We will pay the remaining administrative and arbitrator fees and any additional amount needed to make arbitration accessible as law or NAM’s consumer standards require. Each party pays its own legal fees unless law authorizes an award. The arbitrator may award the individual remedies available in court, including statutory damages and legal fees, and must issue a written decision. A court with jurisdiction may enter judgment on the award.

Class-action waiver. You and Oxxbridge may bring covered claims only in an individual capacity. Neither may pursue or participate in a class, collective, or representative arbitration concerning those claims. The arbitrator may not combine different customers’ claims without all affected parties’ agreement. This does not prevent relief that law makes nonwaivable. A court, rather than the arbitrator, decides whether this arbitration agreement was formed and whether this class-action waiver is enforceable. If the waiver is unenforceable for a claim, that claim proceeds in court; the remaining arbitrable claims remain subject to arbitration.

Thirty day opt-out. You may opt out of this arbitration agreement and its class-action waiver by emailing oxxbridge@gmail.com no later than 30 days after you first expressly accept these Terms. State your name, the email address you used for the store, and that you opt out of arbitration. We will honor a timely notice without affecting your ability to shop. If you opt out, neither party may require arbitration under this section.

Unavailable forum. If NAM cannot administer the dispute, you and Oxxbridge may agree on another administrator. If we do not agree, the dispute may proceed in court under section 16. We will not enforce arbitration if doing so would deny a remedy that cannot lawfully be waived.

16 Court proceedings and overseas customers

Section 15 and its class-action waiver do not apply to customers residing outside the United States. For a dispute not subject to arbitration, the state courts in Bergen County, New Jersey, or the federal court for the District of New Jersey are the agreed courts, except for the small-claims option and any mandatory right to use another court. If applicable consumer law allows you to bring a claim in the courts where you live, you retain that right, and we will bring a claim against you there if that law requires it. No separate jury-trial or class-action waiver applies to a court proceeding under this section.

We encourage you to contact us about a dispute, but doing so is not a condition to exercising a legal right and does not shorten or extend a legal filing deadline.

17 Updates and general terms

We may update these Terms for future use and orders by posting a revised version. We will seek renewed acceptance when needed. Posting an update does not change the dispute terms for an existing dispute or the terms of an earlier order.

We may send order, shipment, refund, and other transaction notices to the email address you provide. Keep it current and retain your order records. Notices that law requires in a particular form will be given in that form.

These Terms, our Shipping, Returns, and Refunds Policy, the product description, and checkout terms disclosed for your order govern that purchase. That policy controls any conflict about shipping, cancellation, returns, or refunds. An express written agreement with you or a mandatory legal right prevails over a conflicting general provision. If a provision is unenforceable, the remaining provisions continue to apply, subject to section 15’s specific treatment of arbitration. A delay in exercising a right does not waive it. Ending website access does not end provisions needed to resolve an earlier purchase or dispute.
